What this website collects, what it does not, and who to contact about it.

This policy covers marcoinkona.com, operated by Marco A. Silva, a licensed real estate broker (RB 20599) affiliated with Coldwell Banker Island Properties (RB 16822) in Kailua-Kona, Hawaiʻi.
It describes how this website handles personal information. It does not cover Coldwell Banker Island Properties’ own systems, the MLS, or any third-party service you reach by clicking a link here. Those operate under their own policies.
The only place this site asks for personal information is the contact form. When you use it, you may provide:
Only a name and email address are required. Everything else is optional.
How the form actually works. Submitting the contact form sends your details to Marco by email. They pass through this site’s server and through Resend, the service that delivers the message.
Nothing you type is stored in a database here. Once the email is sent it lives in Marco’s inbox in the same way as any email you write to him directly. Resend keeps a short delivery log, as any mail provider does.
To respond to your enquiry and, if you become a client, to represent you in a real estate transaction. Practically, that means contacting you about properties, sending market information you asked for, and handling the paperwork a purchase or sale requires.
If you tick the SMS consent box, Marco may text you. If you do not, he will not. You can withdraw that consent at any time by replying STOP or simply telling him.
Your information is not sold, rented, or traded. It is not added to a marketing list you did not ask to join.
Real estate transactions involve other parties by necessity. If you engage Marco, your information may be shared with the brokerage, the other side’s agent, escrow and title companies, lenders you choose, inspectors, and anyone else the transaction requires. It may also be disclosed where the law or a court requires it.
Beyond that, no.
Being straightforward about this matters more than the usual vague list, so here is exactly what runs on these pages:
The site is served by Vercel, which keeps standard server logs including IP addresses, for security and to keep the site running. See Vercel’s privacy policy.
Typefaces load from Google Fonts, which means Google receives a request from your browser when a page loads.
Property films are hosted on YouTube. Nothing from YouTube loads until you click play on a video, at which point Google’s terms and cookies apply. Video titles and thumbnails on the videos page are requested from YouTube’s public API by your browser.
The homepage may display recent posts from Marco’s Instagram. Those images are requested from Meta’s servers. No information about you is sent to Instagram unless you click through to it.
Property maps use OpenStreetMap and Esri map tiles, which are requested from those services when a map is displayed.
This site runs no analytics, no advertising pixels, no Facebook or Google tracking tags, no session recording, and no cross-site trackers. Nobody is building a profile of your visit.
This site sets no tracking cookies.
It does use your browser’s local storage for one purpose: remembering recently fetched Instagram and YouTube content for a few hours so pages load faster. That information stays in your browser, is never sent anywhere, and clearing your browsing data removes it.
Third parties listed above may set their own cookies when their content loads. Your browser settings control those.
This site is meant for adults conducting real estate business. It is not directed at children under 13, and information is not knowingly collected from them. If you believe a child has sent information through this site, contact Marco and it will be deleted.
Because this site stores nothing about you, most requests are simple: whatever Marco holds about you sits in his email and his transaction files.
Depending on where you live, you may have additional rights, including under the California Consumer Privacy Act or the UK and EU GDPR. Marco will honour those requests. There is no sale of personal information to opt out of, because none happens.
The site is served over HTTPS. Since it stores no personal information, there is no customer database here to breach. Information you send by email or text is protected by the security of those services and of Marco’s own accounts. No method of transmitting information is completely secure, and email in particular should not be used for anything highly sensitive such as full account numbers.
This site links to other places, including Coldwell Banker, property search tools, home valuation forms, and social media. Once you follow a link, you are on someone else’s site under their policy, not this one.
If this policy changes, the revised version will be posted here with a new date at the top. Material changes will be noted rather than slipped in quietly.
